Some women decided she wanted to back into me on my way home from work. She then decided she wanted blame the whole thing on me say I was going 40 plus through the parking when I was only go at the most 15. Alls she did was cuss at me thne whole time instead of being calm and just giving me her info. hopefully all gets settled out and we wont have to go to court over it.

That really sucks. the most vulnerable part of your car vs the strongest part of hers. Those Expeditions are big. She backed into you which makes her responsible. You were in the driving lane and she pulled into it. Just like when you run into the back of someone. I hope everything works out ok and you get your car fixed asap.

I am paranoid as can be when I drive through any lot. It always seems that women in huge SUV's pull that crap. Most of the time they will back out in front of you whether your 2 or 20 feet away and EXPECT you to yield to them. Like they have the right away. Half the time they don't even look because they are to busy yapping on the cell phone.

I say if she says you were going 40 tell her to show you the radar gun. Or was she using the ol' calibrated eyeball?:D
Furthermore, if she saw you speeding through the lot why the hell would she pull her precious suv out in front of you?

Sounds like they were on private property (parking lot) and police generally won't work those accidents unless there are injuries. It may be up to them and the insurance companies. Good thing you have some pictures.

Tommys right, but hopefully you wont hafta absorb the loss. maybe her insurance will take care of it. That definitely aint a 40 mph dent either.

it happened in the wells fargo parking lot. and no the cops wont come out for an accident like this. Im guessing ill have to just have the whole quarter panel replaced. Im gonna go up to the body shop and see how much they charge on monday.

Not true. Although I'm in agreement with you, my wife is a claims adjuster for a major insurance company and they will tell you it's more like 70/30. And they'll ask if you used your horn, say YES you honked at her. There is a responsibility of the party traveling down the aisle to look for cars backing out. I'm just the messenger here!

I finally asked her to quit telling me about her claims as it would frustrate the hell out of me They'll find any way not to pay.

And a police report won't help. It will be a matter of how hard you push your adjuster. As long as it is <49% your fault your fine since it won't be chargable, in other words they can't raise your premium because of it.

theres no way I could have seen her cause she didnt start backing out till I was already there. If She would have started backing out before I got there I would have run into her. as far as settlement I think it would be the price of repairs. idk, but a new quarte panel skin is 110.00 and then whatever labor is.

Were there any witesses that might help? Also there should be a surveilence camera shooting that bank lot. Her insurance company will most likley try to claim your car is worth around 500.00 and total it out if they try to settle it at all. You may need to talk with a good attorney if your insurance company won't stand up for you.

Private Property is tricky. I'd bite the bullet and pay yourself to get it fixxed, if she's not willing to. Your deductable is probably $300-$500 and judgeing by the pic, you don't have the best paint in the world so you could probably get it fixxed for just your deductable. Plus your insurance might go up, even if it was ruled 30/70 fault.

But yah, sorry about your Nova! :mad:

I'm guessing your Nova is insured through a standard company instead of a classic car insurer :( . The value of your car is just a couple thousand to them because they use data that shows what the car is worth as a 30 something old vehicle... If you had Classic car insurance like American Collectors or Hagerty (there are a bunch out there) you would have what is called "agreed value" and they set that value when you negotiate what the car is worth when you buy the policy. If you and the ins company agree the car is worth 10,000 and it is totalled you get the 10 grand. In your situation they would repair the car at a shop of your choice. Classic car insurance is cheap, about 150-200 bucks a year. If that is your only car they might not insure it as most compnies want you to have a daily driver on standard policy and feel the hotrods should be driven less each year (the reason for the great rates).

If you ran into her and your front end was smashed up, then I would think it was your fault.

But the location where she hit you clearly shows she was at fault the way I see it.

By the way...how's your neck/back feeling today?

Whiplash from getting ran into can be a funny thing and often would not feel the effects right away. :beat:

I want to stress this again. There most likley was a camera watching that lot somewhere. Find the tape, and you have your evidence. In todays society your watched most of the time. Some folks think that's ok. I think it's scary as hell.

Yes it may be scary that the goverment feels that it needs to watch your every step they will do what they want and theres no stoping them, but why would you be scared unless you have something to hide:D

Years ago, I was following a car in a lot and he passed a spot and stopped, threw it in reverse and backed into me tail on. I had stopped the same time as him and then beeped for his whole reverse move and he kept coming. Hit me and then claimed I rear ended him. I was totally and completely shocked. When witnesses approached he actually paid them to leave. Police came and he denied everything. Not one soul on this earth believed what happened at the time. Changed my perspective about people in a very large way.

Man, that sucks bad - i know as I am sporting a series of dents almost identical to the location of yours. It was the worst feeling. Especially when you know 100% it wasn't your fault.
Thankfully my assailant admitted full responsibility and his insurance paid in full for the damage - but it took a while as they really hadn't done anything with 'historic' vehicles before.
My fingers are crossed that this all gets worked out for you. :cool:

Almost forgot to warn you...
They may try to pull some B.S. about only giving a 'depreciated value' (apparantly 1% per year for the age of the vehicle) for the amount of any repairs to the body. I fought it as they were only going to give me part of the body work amount and not pay for paint at all.
